I think it is, at least in some places. Look in news stories under "potty parity", for a case I remember from a few years ago.

Women complain that stadiums don't have enough women's rooms or stalls. So in Texas, I think, a few years ago, a woman used a men's room at a stadium because the women's rooms lines were too long, and she was arrested.

I think she was a state legislator and made sure the problem got lots of publicity. And stadium owners promised to do something about it.
