What would the charge be? As long as it's his flag, he can do with it as he pleases - the Supreme Court has quite a history of overturning anti-flag-burning legislation, and has made it abundantly clear that destruction of or disrespect for the flag is considered a form of symbolic speech and is protected by the First Amendment. The most punishment he can be given for that is that people he pissed off won't be buying his albums or attending his concerts - the law has nothing to say to him.

Which I firmly support. I'm a big fan of freedom of speech. I didn't see the show, so I have no idea about the context and implications, but unless he cut a hole in a flag that belonged to someone else, or maybe cut a hole in that flag in a reckless manner and endangered the lives of thousands - say, by hanging it up across the seats and having place-kickers punt running chainsaws toward it - I don't see as he's done anything for the law to care about.
