Well, in some cases they don't release their special edition and normal edition DVDs at the same time. Usually there's some distance between them, either with the normal edition coming first (such as with The Princess Bride) or with the special edition coming first (such as with Final Fantasy and a whole bunch of other movies). But yeah, there are certainly cases out there where a DVD is billed as a special edition despite being an only edition, probably to draw attention to the extra things that were added to the DVD in contrast to the straightforward VHS release. But calling a DVD "special edition" when it isn't special in any particular way, that's just stupid.
